Trade Terms & Conditions (V2.0)
Policy Statement
It is a key policy of our Company to provide a standard of product and service that will make it a
pleasure for you to deal with us, so that you will want to deal with us again and recommend us to
your colleagues. We do our best to deal with all matters in an enlightened and friendly way, and
if you take the same approach with us, then in practice we are likely to provide a higher level of
service and support than these Terms and Conditions require. Do please bear this in mind when
dealing with us.
Definitions
I.
“The Goods” shall mean the items or products supplied.
II.
“The Company” shall mean Puretone Ltd.
III.
“The Customer” shall mean the person or company placing an order or to whom the
Goods and/or services are supplied or to whom the Goods are hired.
Prices and Payment
I.
Prices in insert pricelists are exclusive of VAT and postage costs, unless stated
otherwise. The Company reserves the right not to accept an order and shall not be
required to give any reason for so doing.
Quotations are valid for 30 days from date of issue.
Force Majeure
The Company shall not be responsible or liable for its failure to perform its obligation if such failure
is beyond the control of the Company, whether caused by acts of God, unavailability or shortage of
components or energy necessary to produce or deliver the Goods by usual modes of transportation,
fire, flood, war, embargo, strikes, labour disputes, explosions, riots, regulations, acts of terrorism,
restriction or orders of any governmental authority, or any other cause, beyond the Control of the
Company or its suppliers.
Returns Policy
Should any purchased Goods not meet with the Customer’s expectations and the Customer wishes
to return said goods the Company will refund all purchase costs (less carriage costs) of any Goods
that are returned to the Company in their original packaging and in a pristine and resaleable condition. To assist the Company in handling returns correctly the Goods should be securely packed
and the parcel should include a covering letter detailing the reason for return. The Company
reserves the right to decline the return of any product of a personal nature should there be, (in the
Company’s sole judgement), an unacceptable hygiene or health and safety risk. Permitted Returns

The Company reserves the right to suspend deliveries and the right to cancel orders
where payment for any order, related or otherwise, has not been made by the due
date.

IV.
In the event of late previous payment by the Customer, the Company reserves the
right to accept subsequent orders only on the basis of pro forma invoices.

In the event of cancellation of an order by the Customer, the Customer shall be liable
for all costs incurred by the Company on that order, including loss of profit, which
cannot be recovered by sale of the Goods to other customers.

Should credit terms be agreed, the Company’s standard credit terms are payment
within 30 days of the date of issue of invoice. Should all or any part of an invoice re
main unpaid after 30 days, the Company reserves the right to charge interest on the
unpaid amount at the rate specified on the invoice.
Prices and data herein may be subject to change without prior notice. E&OE.
Shipment
While every effort will be made to deliver on or before the dates agreed (if any), any dates given are
estimates only. No guarantee of delivery dates can be given, and time shall not be of the essence of
the Contract for delivery.
Title and Risk
Ownership shall pass to the Customer only on receipt by the Company of the full invoice price of
the Goods, and any additional charges containing within the invoice, including, but not limited to,
carriage, insurance, special order surcharge, etc. In the event of the Company’s terms of payment
not being met, or of any circumstances which may lead to the appointment of a receiver or liquidator
by the Customer before payment has been received, the Customer shall allow the Company access
to enter the Customer’s premises for the purpose of recovery of the Goods. Risk in the Goods shall
pass to the Customer on arrival of the Goods at the delivery address specified by the Customer.
Health and Safety
It shall be the Customer’s responsibility to ensure that the Goods are used according to the instructions provided, and also to ensure that they are used in a generally safe and responsible manner by
appropriately qualified and experienced personnel.
Warranty
I.
The Company guarantees all Goods manufactured by the Company to be free from
any defect due to faulty design, materials, or workmanship for a period of 12 months
(or as stated on the sales invoice if different) from the date of dispatch, provided
that the Goods have been operated and maintained as recommended by the
Company. Any such faults will be repaired, or the Goods replaced, free of charge;
repair or replacement to be at the Company’s sole discretion.
II.
For Goods supplied but not manufactured by the Company, the guarantee shall be
the same as that given to the Company, by the manufacturer. Please note that certain
items from 3rd Party manufacturers, such as bulbs, have a limited operating life and
consequently may have a shorter warranty period.
III.
The Company accepts no responsibility for incidental or consequential damages.
IV.
Any costs associated with returning goods to the Company for repair or replacement
shall be paid for by the Customer, said costs to be refunded if the Goods are deemed
by the Company to be faulty and under warranty.
V.
It shall be the responsibility of the Customer to insure the Goods against any loss or
damage while they are in transit or otherwise away from the Customer’s premises.
(†) Only ‘unworked’ kits, as supplied by the Company, may be returned for credit.
(*) Only RIC devices may be returned for credit. Receivers are non-returnable once the packaging
seal has been broken.
(#) £30 restocking charge per arm will apply if the arms have been cut or altered.
(**) Accessory products may be subject to a re-stocking charge at the Company’s discretion.
Notwithstanding the Returns Periods listed above, all earmoulds and custom-fit devices are offered
with a 30-day fit guarantee from the date of despatch. In the event of a poor fit the Company will
remake/modify free of charge (at the Company’s discretion) the same style/type of earmould or
custom-fit device. In the case of an alternative earmould or custom-fit device being required this will
be chargeable at the prevailing list price. Special order products can only be returned for credit at
the Company’s discretion.
Returns Postage and Pre-Paid Labels
Please note it is the responsibility of the Customer to incur the carriage costs for Goods returned
for any reason other than being faulty. Any Goods returned using a pre-paid address label for any
reason without prior approval, will result in the Customer’s account being charged.
Arbitration
Arbitration in the event of any dispute not settled by the parties shall be submitted in London in
accordance with and subject to the provisions of the Arbitration Act (1950) (or any amendment or
re-enactment thereof) currently in accordance with English Law including statute Law.
Binding Statement
These Terms and Conditions are binding, and form part of any sales contract entered into between
the Company and the Customer. If any of the terms or requirements of the Customer’s order are
inconsistent with these Terms and Conditions, then such terms or requirements shall not form part
of the Contract between the Customer and the Company and shall not be binding on the Company
unless agreed by the Company in writing. Statutory Consumer Rights, as defined by law, remain
unaffected.
